Dell’s international sales violate e-commerce patent, lawsuit says


DE Technologies Inc., an e-commerce technology provider based in Blacksburg, VA, is charging Dell Inc. in federal court of infringing on its patented method of conducting international, web-based computer-to-computer sales.

The suit, filed in Oct. 27 in U.S. District Court in Roanoke, VA, claims that Dell began conducting international computer-to-computer sales after DE Technologies introduced its Ushop technology platform in 1996.

“After DE Technologies’ development effort, Dell began to utilize the Internet for international commercial transactions using back-end and middleware software indiscernible to the ultimate purchaser,” DE Technologies says in its complaint.

It adds: “Since DE Technologies developed its technology and filed their [patent] applications, it is estimated that Dell now processes over 4,500 export transactions on a daily basis and screens over 7,000 export transactions per day from the United States alone. Dell is generating more than 50 million dollars per day in sales from their worldwide web sites, a portion which are international computer-to-computer transactions.”

A spokesman for Dell, No. 2 in Internet Retailer’sTop 300 Guide to online retailers, declined to comment on the suit, noting that Dell was still reviewing the its details.
